The Massachusetts month-to-month lease, “tenancy at will,” is a rental contract between a landlord and tenant that has no specific end date. The contract is renewed with each of the tenant’s monthly payments. Even though the agreement is renewed only by the tenant’s payments, both parties must give the other individual a written notice before terminating the lease. If the tenant breaks their lease, the landlord must follow the same eviction process as a standard rental contract. It is advised that a tenant be accepted only after the landlord has verified their financial background and credit history with the rental application.

Rent Increase (Tenant’s Rights) – No legal limit to the amount of rent a landlord can charge. For the rent increase to be valid, the landlord must give the tenant proper notice of a raise in rent.

Minimum Termination Notice (Chapter 186 Section 12) – Either party must give a termination notice at least thirty (30) days before the next payment date.
