California Month-to-Month Lease Agreement Template
The California month-to-month lease agreement is popular with individuals that do not plan on residing on property for a predetermined amount of time. With a month-to-month tenancy or tenancy at will, the contract ends and begins every thirty (30) days. While this type of lease agreement is less constricting than the average, it is still recommended that the landlord perform a background check on the new tenant with a rental application, as crucial information can be uncovered through this process. Along with a background check, the landlord should request a security deposit to ensure any damage to the property is taken care of in advance.
Rent increase (Civil Code Section 827 (b)) – If the increase is ten (10) percent or less than the initial amount, thirty (30) days’ notice must be provided. If the increase is greater than ten (10) percent, the landlord must give sixty (60) days’ notice.
Minimum termination (§ 1946) – Either party must give at least thirty (30) days’ notice.
