The North Carolina month to month rental contract, or Tenancy at Will, is a form used by residential landlords and tenants when an arrangement would like to be made where there is no end date but either party may cancel or terms with at least seven (7) days notice (Statute 42-14). This type of relationship usually comes into effect after a tenant has rented a property for a year from a landlord and both parties feel comfortable enough to enter into this sort of relaxed arrangement.

If the landlord is taking on a new tenant they should be weary as the same landlord-tenant laws apply (Chapter 42) to month to month relationships as standard one (1) year agreements. Therefore the same exposure to a possible eviction is present and the landlord should take the same precautions such as handing the potential lessee a rental application to ensure they are credible to take on the monthly payments.

Landlord Disclosures

Lead-Based Paint – For any housing that is to be occupied by a tenant and was built before 1978.

Security Deposit Location – Within thirty (30) days the landlord must fit the tenant with the whereabouts of the tenant’s funds including the bank name and address.
