The Ohio month-to-month rental agreement is a special type of contract that has no predetermined end date and may be terminated by either the landlord or tenant with at least thirty (30) days’ notice. Despite the unique nature of this type of tenancy, the landlord and tenant will be bound by the same eviction procedures that govern fixed-term leases. Therefore, it is imperative that the property owner/manager ask the lessee for their personal information and income credentials with the rental application to reduce the chance of a future eviction. Upon approval by the landlord, the rental agreement should be filled in with both parties’ information and signed to authorize the contract.

Rent Increase – No statutory law concerning the amount of notice required to increase rent.

Minimum Termination Notice (§ 5321.17) – Thirty (30) days’ notice for monthly tenants, seven (7) days’ notice for weekly tenants.

Disclosures

Identification (§ 5321.18) – The tenant must be informed of the name, address, and phone number of the landlord and any manager or agent permitted to act on their behalf.

Lead-Based Paint – According to federal law, the landlord must provide this disclosure to the occupants of any housing unit built before 1978 to inform them of the potential exposure to lead paint.
