The Rhode Island five (5) day notice to quit is a notice sent to a tenant who is late in their rent payment. After rent has been overdue for fifteen (15) days, the landlord has the right to demand that the tenant cure the breach of contract within five (5) days. Failure to cure the breach will result in automatic termination of the rental agreement currently in place between the two parties. Furthermore, the landlord has license to commence an eviction action in housing court.

When is Rent due? – Unless the rental agreement says otherwise, rent is to be paid at the beginning of the month (§ 34-18-15(c)).

Laws  (G.L. 1956 § 34-18-35) – This 5-day notice may be sent to the tenant once rent has been in arrears (late from the due date) for at least fifteen (15) days.
