The Virginia five (5) day notice to quit form is used to warn a tenant that they have defaulted on their rent payment. A landlord may only deliver this notice to a tenant once five (5) days have passed since the rent due date. If the tenant fails to pay money owed within those five days, the landlord may terminate the lease agreement and retain possession of the property. Failure to vacate the property could result in an eviction process being started by the landlord.

When is Rent due? – Unless otherwise written in the lease agreement, rent shall be due on the first day of each month of the tenancy (§ 55-248.7.C.4.).
