Montana Sublease Agreement Template
The Montana sublease agreement is used when a tenant wishes to rent all or a portion of rented space to another party known as a “sublessee.” The period during which the sublessee is permitted to rent the property may not exceed that of the original lease term. Montana statute § 70-24-305 states that if a tenant vacated a property, they cannot rent the premises to someone else without first obtaining the exclusive written permission of the landlord.
Responsibility
The sublessor (initial tenant) will bear the full responsibility of the sublessee and will take the fault if any part of the master lease is broken with respect to the monthly payment, damage, and vacating at the proper time. For these reasons, it is encouraged that the sublessor requires all potential sublessees to complete a rental application before officially signing a sublease.
Disclosures
- Lead Paint – This document informs tenants of the possibility of lead-based paint contained in the home. Only required if the unit was constructed prior to 1978.
- Move-in Checklist – Required if the sublessor requests a security deposit at the time of the lease signing.
