The Oregon sublease agreement is designed for a tenant looking to rent either their entire space or a bedroom to someone else. Permission to sublet must always be obtained from the landlord if the original lease does not state that subletting is allowed. The original tenant, or “sublessor,” will be held liable for any damage and will remain responsible for making the monthly payment regardless of whether the new tenant, or “sublessee,” decides to pay. The sublessor must follow all State laws and provide subtenants with the following disclosures (if applicable):

  • Carbon Monoxide (§ 90.316) – If there are any devices that release carbon monoxide into the air, the landlord must provide testers and distribute this disclosure to each tenant.
  • Flooding (§ 90.228) – If the property is in a flood zone, the tenant must be made aware (see 100-year flood map).
  • Lead-Based Paint – The sublessor may have to check to see if the property was built prior to 1978. If so, this form must be attached to the sublease to inform the subtenant of hazardous lead paint potentially contained in the unit.
  • Smoking Policy (§ 90.220) – The original tenant should pass on the same form that they received from the landlord when they signed the lease.
