A Sub-Lease Agreement is an agreement in which the original tenant, called the “Sub-lessor” rents out the currently rented property to another party, now called the “Sub-lessee”. Keep in mind that if the landlord does not receive the Sub-lessee’s monthly payment, the original tenant is still liable to pay the landlord that month’s full rent. Because of that reason, it is strongly recommended that the Sub-lessor does a full background check on the potential new Sub-lessee. It is also important to inform your landlord of the new Sub-lessee(s) to create a base of understanding through all of the parties.

For the contract to have it’s full legal effect, the Sub-lessee and Sub-lessor will have to agree on the below points.

  • Utilities
  • Property Condition
  • Deposit
