A commercial lease is a real estate document for the use of retail, office, or industrial type space between a landlord and a tenant looking to use the property for business use. The landlord should always review the tenant/business to see their financial status as well as review their filings with the Secretary of State office to make sure that they are up to date with their entity status. When reviewing the tenant’s credentials it is a good idea to see past tax filings to see how much business they have done in previous years and if it is a new business a personal guarantee should be mandatory.


Rental Application – Before accepting any business or individual as a tenant it is always recommended that the landlord perform a lookup of the entity in addition to the individual to see if they are financially capable of entering into a commercial rental contract.

By Type

  • Gross Lease – Tenant makes a single payment of rent while the landlord takes the responsibility for all expenses on the premises including but not limited to: taxes, insurance, electricity, water/sewer, etc.
  • Industrial Lease – For space that is primarily used for warehousing or storage.
  • Office Lease – Space that is generally for professional services such as insurance agencies or medical suites.
  • Retail Single-Tenant Property Triple Net (NNN) – For a single user on a property that will be selling goods directly to consumers.
  • Retail Multi-Tenant Triple Net (NNN) – For a property that has multiple tenants that sell goods to consumers. The landlord and tenant can agree to any non-compete arrangements in order to have the tenant be the only type of user on the property (example: Pizza Hut not wanting a Domino’s Pizza next door).
  • Commercial Personal Guarantee Form – Document to guarantee the lease so that if the Tenant’s business entity defaults on the lease the person who owns the company shall also be liable.

How to Write (Gross Commercial Lease)

Step 1 – Download in Adobe PDF (.pdf).

Step 2 – Submit the following:

  • The date of the execution of the agreement  in mm/dd/yyyy format
  • Landlord’s name
  • Complete address
  • AND
  • Tenant’s name
  • Tenant’s complete address

Step 3 – Tenant shall agree (and landlord shall complete) to the following:

  • Enter the address of the premises

Security Deposit –

  • Landlord must enter the security deposit due at signing

Possession –

  • Landlord must enter the date in which they shall release the property into the tenant’s possession for the longevity of the lease

Property Insurance –

  • The landlord must enter the amount to be charged for property insurance

Indemnity and Liability Insurance –

  • The landlord must enter the minimum amount acceptable for single limit coverage
  • Minimum for protection of property
  • Minimum for death of persons

Step 5 – Titled Sections  –

  • The tenants, must read and agree to sections 9 through 36
  • In section 37, should there be any addenda and./or exhibits to be attached, they must be listed here and attached to this document

Step 6 – Signatures  – As the document is completed submit the following:

  • Landlord’s signature
  • Title
  • Date of signature in mm/dd/yyyy format
  • Time of signature in hour/minute format
  • AND
  • Tenant’s signature
  • Title
  • Date of signature in mm/dd/yyyy format

How to Write (Industrial Lease)

  • Landlord shall provide the date that the tenant shall take possession of the property

Landlord –

Step 3 – Section 1 of Titled Sections – If any of the information is unclear to the tenant, it’s recommended that the tenants consult with an attorney to ensure clarity:

How to Write (Single-Tenant NNN)

Step 1 – Download in Adobe PDF (.pdf) or Microsoft Word (.doc) for a triple-net (NNN) retail property for the use of one (1) tenant.

Step 2 – Establishment of Lease Agreement – Submit the following:

  • The date in which the lease is established in mm/dd/yyyy format
  • Landlord’s name
  • Name(s) of Tenant(s)

Step 3 – Lease Summary Information – Landlord must enter:

  • Legal description as listed in Exhibit A
  • Enter the period in months and/or years of the lease
  • Date of the commencement of the lease in mm/dd/yyyy format
  • Submit the date the lease shall terminate
  • AND
  • Check the applicable box with regard to the base rent amount
  • If there shall be prepaid rent, the landlord must enter the sum of the prepayment
  • Enter the months that the prepaid rent shall cover (from and to)
  • Provide the security deposit amount and check the box that shall apply as to the method of payment

  • Landlord must enter a description that shall specify the use of the premises

Step 4 – Notice and Payment Information – Both parties must provide information for reliable written notice and payment locations. Landlord and Tenant must enter the following:

Step 6 – Section 3 – Term –

  • Landlord must enter a date in mm/dd/yyyy format and provide notice within 30 days of the commencement date of the lease to inform the tenants as to the date the premises are completed for possession by the tenants
  • Landlord and Tenant must then carefully review subsections a and b.
  • Landlord must enter a date within a 60 day time frame, should the possession period be delayed, providing an election right for the tenant to cancel the lease within 10 days of the date provided in section 3, subsection b (mm/dd/yyyy format)
  • Both parties must read and agree to the remainder of this section

Step 7 – Section 4 – Rent –

  • Landlord must check the applicable box
  • If the date shall be other than the commencement date, enter another date in mm/dd/yyyy format
  • Landlord and Tenant(s) must review the remaining subsections a, b, c and d

  • Landlord and Tenant(s) must read and agree to all sections and subsections 5 through 33

  • If the landlord has representation, the landlord must enter both the name of the broker and the licensed firm
  • If the tenant(s) are represented, the tenant(s) must enter both the names of the broker and the firm that’s licensed and has permission to represent the tenant(s)

Step 12 – Section 37 – Broker Provisions and Parties Signatures – Signatures must be submitted in witness of a notary public only:

  • Landlord(s), Broker(s) and Tenants must review the statement at the top of section 37
  • If all are in agreement, landlord(s) (or agents) must submit their signatures
  • Once the signatures have been provided before the notary, the notary shall the, again witness and record the signatures of each signatory, affixing their official seal to each signature in acknowledgement
