A month-to-month rental agreement, or “tenancy at will”, is a rental contract between a landlord and tenant that can be terminated at any time. The most common notice requirement is thirty (30) days but ultimately depends on State termination laws.

How to Write
Step 1 – Download in Adobe PDF (.pdf) or Microsoft Word (.doc).
Step 2 – The Parties –
- Enter the landlord’s name
- AND
- Enter the name of the tenant(s)
Step 2 – Premises –
- Submit the complete physical address to be leased to tenant
Step 3 – Lease Term –
- Provide the date, in mm/dd/yyyy format as to when the lease shall commence and continue month to month
Step 4 – Lease Payments –
- Submit the agreed dollar amount of rental payment to be made
- Provide the day each month in which payments are due on or in advance of
- Enter the locations where payments shall be received
Step 4 – Late Charges – Landlord must enter:
- The day of each month that rent is due
- The day that the rental payment is considered late
- A daily amount to be added to the late payment until rent is paid
- A day of the month when non-payment places the tenant in breach of contract
Step 5 – Insufficient Funds –
- Landlord must enter the fee to be paid if a rental payment is returned due to insufficient funds
Step 6 – Security Deposit –
- Landlord must enter the amount of security deposit to be paid upon signing and to be returned after and dependent upon the results of the final inspection
Step 7 – Defaults –
- The landlord must enter the number of allowable days to cure any default
Step 8 – Titled Sections –
- Tenant(s) and Landlord(s) must read and agree to all of the remaining titled sections, prior to application of signatures
Step 9 – Signatures –
- The landlord must enter their signature
- Date the signature in mm/dd/yyyy format
- AND
- Tenant(s) must provide the following
- Printed name
- Vehicle Information as follows:
- Year
- Color
- Make/Model
- License Plate Number
- Signature
- Date signature in mm/dd/yyyy format
- AND
- Telephone Numbers:
- Print name
- Home phone
- Work phone
- Cell number
- Signature
- Date signature in mm/dd/yyyy format
